B2B Master Services Agreement

Terms of Service

1. Acceptance & B2B Relationship

By registering a business account or subscribing to KiteOrdr services, you ("Subscriber" or "Restaurant Client") enter into a legally binding B2B contract with KiteOrdr Technologies ("KiteOrdr"). If you are subscribing on behalf of a company, franchise, or restaurant entity, you confirm that you hold the legal authority to bind that entity.

2. Restaurant Account & Menu Data Accuracy

Restaurants maintain sole responsibility for all catalog data uploaded to KiteOrdr, including dish pricing, tax rates (GST/VAT), allergen warnings, and availability tags. KiteOrdr is not liable for customer disputes or billing discrepancies resulting from inaccurate menu entries uploaded by your staff.

3. Data Processing Agreement (DPA)

Under applicable data protection legislation (including DPDP Act 2023 and GDPR), the Restaurant Client acts as the Data Controller for any diner ordering data, while KiteOrdr acts as the Data Processor. KiteOrdr processes table order payloads solely to route orders to your kitchen and will never sell or monetize diner order information.

4. Subscriptions, Renewals & Free Trial

KiteOrdr provides a 14-day free trial on selected plans. Paid subscriptions are billed automatically on a recurring monthly or annual basis. You may cancel your subscription at any time via your merchant dashboard. Cancellations take effect at the conclusion of your current billing period.

5. Service Uptime SLA & Limitation of Liability

We target a 99.9% operational uptime for digital menu serving. To the maximum extent permitted by law, KiteOrdr shall not be liable for indirect, incidental, or consequential damages (including loss of dining revenue or third-party WhatsApp network outages) arising out of service interruptions.

6. Acceptable Use Policy

Subscribers agree not to use KiteOrdr QR assets for fraudulent links, malware distribution, phishing, or unauthorized promotional messaging. Violations will result in immediate account termination without refund.
